Maui Property Owners Association



I am a real estate professional living and working on Maui for over 20 years and been in the real estate industry over 30 years. I have always been a life long advocate of individual private property rights. This site, Maui Property Owners Association.Com is dedicated to protecting these rights for ALL the property owners of Maui, those living on Maui and those not.

Private property rights are a cornerstone of our free society, the god given right to freely enjoy, transfer or rent private property is the only thing standing between freedom and totalitarian control by a government.

Recently the private property rights of Maui's property owners have come under attack. The current administration of Charmaine Tavares and the sitting county council have pressured the planning department into threatening property owners that have chosen not to rent to "locals only" with huge fines for violations of laws that simply don't exist. In an attempt to vivify these owners, they have started calling the property of anyone not renting to locals only "Transient Vacation Rentals" or TVR's that they say MUST be regulated, yet if the same property is rented to locals, it's just a rental property that doesn't require any regulation (yet?), or is this the first step to require regulation of ALL rental property? Will you soon need a "permit" to rent any property? Will the county tell you who you can rent to? Will they tell you how much you can charge in rent? It's a very slippery slope once we allow government to get involved in the renting of our private property!

With property owners being told that renting to someone "not from here" requires a permit and is considered the operating of a business. Yet, renting to locals is OK and does not require any permit of any type? This is a gross violation of the equal protection clauses of the United States Constitution. Placing restrictions on the length of time a property can be rented, or to who it can be rented reduces the value and utility of a property and is therefor a "Taking" of property without compensation which is protected by United States Constitution and can not be tolerated.

The renting of private property to who ever an owner chooses, to a visiting family of someone down the street, a working single mother, a brother from the mainland, or a family from south Africa, for 1 day, 1 week or 10 years, it's up to the property owner, not the government! It's a basic private property right that must be protected and no government has any right to interfere with this private property right! If they do, they must compensate the owner for any loss of value the property owner suffers, it's US constitutional law.

All of the private property owners of Maui must come together to fight for these rights. Even if you are not currently renting your property, this effects YOU, you may wish to rent it in the future, your childern may wish to rent it, or someone you sell to may wish to rent. This effects all of Maui's property owners for generations to come. Together we can not be defeated, divided we will fall pray to a government that is showing no respect for private property rights.

Our current political structure is a severe threat to the private property rights of Maui's property owners. A strong "Maui Property Owners Association" representing ALL Maui property owners is needed to insure that private property rights are protected for generations to come. Such an association will be a powerful political force that cannot be ignored by local government and can effect positive change in Maui county. We especially need the help of any attorneys interested in doing pro bono work for the association, attorneys familiar with federal property rights & civil rights law,accountants, anyone wishing to serve on the interim board of directors. The only requirement is a burning passion to protect the private property right against government intrusion.
